The purpose of this statement is to request an abatement of penalties based on reasonable cause for failure to file form 990-PF for the year 2022 by the deadline on May 15 2023 with the Internal Revenue Service IRS which we are filing on this date May 10 2024 with this request for an abatement of penalties as an attachment. I am making the declaration that all statements made setting forth all the facts alleged as reasonable cause in the entirety of this letter are made under penalties of perjury. We had no operations during 2022 other than incorporation and designation of federal tax exemption status and commenced preliminary business activities in the form of site selection in late Spring of 2023 with primary operations beginning on September 28th 2023. We have not had any experience with the formation or regulation structure of business entities or their tax regulations prior to the formation of 4th Dimension Living and believed that because there were no operational and financial activities that occurred in 2022 that there was not a requirement to file tax returns for the entity with the IRS. As part of our process to file form 990-PF for calendar year 2023 with the IRS it was brought to our attention that we had not filed for year 2022 and that there is a requirement to do so annually whether or not we have income or activity during the year. As soon as the mistake was brought to our attention we took corrective measures to file the 2022 Form 990-PF in a timely manner and fully intend to comply with the law at all times. We are current with our 2023 Form 990-PF filing as well. We have taken affirmative action in order to prevent this non-compliance and comply with all laws moving forward by engaging a CPA to maintain our books and records and prepare financial statements in accordance with United States Generally Accepted Accounting Principles in a timely manner as well as advise on the timely and accurate filing of all required tax documentation with the IRS and related state agencies. Our failure to comply with laws and regulations of the Internal Revenue Service was due solely to an ignorance of the law and in no way constituted a conscious intentional failure reckless indifference or willful neglect of the law.
