It was established as a Swiss Federation Association being the French legal term under the provisions of Article 60 et seq. of the Swiss Civil Code. World Heart Federation qualifies as a publicly supported organization under IRC 509a2: An organization that normally receives 1more than one-third of its support in each taxable year from contributions membership fees and gross receipts from activities related to its exempt functions subject to certain exceptions; and 2 no more than 1 3 of its support from gross investment income and unrelated business taxable income less section 511 tax from businesses acquired by the organization after June 30 1975. This was confirmed by a review of financial statements of the World Heart Federation. Part IV, Section A line 4B Article 13 of the governing instrument of the Trust provides as follows: If the Trustees make a grant to the World Heart Federation they shall follow the procedures set out in this Article. The Trustees shall require that requests for funds specify the use to which the funds will be put and if the Trustees approve the request they shall authorize payment of such funds to the World Heart Federation. The Trustees shall require that the grantee furnish a periodic accounting to show that the funds were expended for the purposes which were approved by the Trustees. The Trustees may in their absolute discretion refuse to make any grants or contributions or otherwise render financial assistance to or for any or all of the purposes for which funds are requested. Part IV, Section A line 4C The Trustees shall at all times have the right to withdraw approval of the grant and use the funds for other charitable scientific or educational purposes as are consistent with the purposes of the Trust as set forth in Article 2. Notwithstanding the foregoing any gift to the Trust solicited for a specific use by the World Heart Federation in fulfillment of its charitable purpose or otherwise designated by the donor for such specific use shall be distributed to the World Heart Federation for such use.
