CCCOEO is eligible to deduct charitable contributions under Section 170(b) (A) and is classified as an organization other than a private foundation under Section 509(a)(2). CCCOEO regularly reviews and evaluates its tax positions taken in the previously fled information returns and reflects in its financial statements concerning issues affecting its tax exempt status unrelated business income and related matters. CCCOEO believes that in the event of an examination by taxing authorities its position would prevail based upon the technical merits of such positions. Therefore, CCCOEO has concluded that no tax benefits or liabilities are to be recognized. Gentleman, I'd like to provide a brief explanation of the factors that lead to our return being submitted late. We have had recent turnovers in our accounting department. In addition, our Board of Directors have displayed uncertainty and fluctuations in their decision making with the pending retirement of the Executive Director of over forty-nine (49) years. The final review of the report is completed by the Executive Director. The report was not returned in a timely manner for submission. We hope the IRS would understand that with all of these events combined, it would lead to this isolated incident. The following corrective measures have been implemented: The audit will be conducted earlier in the year. Additional staff have been hired. The Executive Director is committed to review in a timely manner for submission. In reviewing our filing history, our returns have been Filed & Accepted or Extended & Accepted since 2017 without issue.
