questioned whether or not a 12/31 tax return is applicable. The taxpayer has not petitioned for a calendar year change from its 50 plus years as a 9/30 fiscal year filer with all years timely filed and paid as a 9/30 filer. Additionally, incorrect assessments of taxes due have arisen as IRS has not given credit for repeated EFTPS estimated payments. As the 9/30 year end timely estimated payments have notbeen applied to the proper tax year with the added problem of looking for a non existant December year end return. Further, the perplexing result of the misapplied payments not causing an overpayment in another tax year. Taxpayerhas records to show 9/30 year end with resulting tax obligations as paid through the EFTPS. Form 990PF-General Explanation Attachment 2 Explanation of two Chairmans, long time Trustee and Chairman, Donald D. Smith departed this life on 9/6/24 and Hansell L. Smith became Chairman thereafter. Mr. Smith had been paid his Trustee Fees for being the Chief Operating Trustee for the fiscal year prior to his death while the successor Hap Smith finished the year without compensation in honor of Mr. Don Smiths sixty years of service to the foundation. Form 990PF-General Explanation Attachment 3 This September 30, 2024 (2023) tax return is the final return as a fiscal year taxpayer as the client will file a short year December, 2024 to change the taxable year to a compliant calendar year and to curtail the constant misunderstandings.
