During the current and prior year, the Organization was unable to meet the 33 1/3 "publicly supported" test due to circumstances beyond its control; the government of Calvert County MD has temporarily suspended its conservation certification program which is the primary tool used by this Organization in preserving agricultural farmland. While the local government's certification program has been suspended, the Organization's ability to raise funds from its membership, attract the general public, and to carry out conservation transactions has been significantly restricted. It is our opinion that the organization meets the publicly supported "facts and circumstances test" as evidenced by the following factors: our annual newsletter with the express purpose of attracting public support, our governing body is made up of community and governmental leaders with a special knowledge of conservation practices, our easement inspection services rendered to the State of MD Rural Legacy Program, and lastly, our endowment which is comprised of member contributions and governmental support funds from previous conservation transactions.Once Calvert County restarts its preservation certification program, the public support test of 33 1/3 is expected to return, as it has done in the past 29 years of the Organization's existence. Part IV, Line 2b: The Organization holds in escrow principal amounts provided by the State of Maryland - Rural Legacy Program. The State Program requires its preserved properties to be inspected every third year; the interest income generated from the escrow funds is kept by the Organization in return for providing ongoing easement monitoring services.
