The ruling is inconsistent with Pennsylvania statutes and case law. The organization has been severely burdened by the loss of its facilities. Animals and plants on the premises were subject to USDA licenses and had to be transferred to appropriate facilities or destroyed. IBP's business was transferred to Wildlife Preserve, Inc., a nonprofit entity that was able to perform all active IBP contracts using many former IBP employees. IBP was able to return all deposits received for which IBP was no longer able to provide the service reserved. Priority has been given to IBP's appeal to the Superior Court of Pennsylvania.
